Warranty, Terms & Conditions
Thank you for choosing Allen Miller Fabrication. These Terms & Conditions establish the expectations regarding estimates, deposits, scheduling, fabrication, installation, warranties, specialty products, and digital downloads.
Approval of an estimate, payment of a deposit, purchase of products, or authorization to begin work constitutes acceptance of these Terms & Conditions unless otherwise agreed to in writing.
Payment Terms
A 50% deposit is required to reserve your place on our schedule and begin fabrication.
The remaining balance is due upon project completion, pickup, or delivery unless otherwise agreed to in writing.
Projects requiring specialty materials or custom-ordered components may require additional deposits as outlined in your estimate.

Once materials have been ordered or custom fabrication has begun, deposits become non-refundable.
Late Payments
Invoices not paid when due may be subject to interest at the maximum rate permitted by applicable law.
Customers may also be responsible for reasonable collection costs, attorney fees, court costs, and other expenses incurred in collecting unpaid balances where permitted by law.
Estimates
Unless otherwise stated in writing, estimates are valid for 30 days from the date issued.
Material prices and labor costs are subject to change after this period.
Scheduling
Estimated completion dates are provided in good faith but are estimates only.
Schedules may change due to:

Weather
-
Site conditions
-
Customer-requested changes
-
Inspection requirements
-
Other contractors

Circumstances beyond our control
If delays occur due solely to Allen Miller Fabrication, we will communicate promptly and work to complete the project as quickly as reasonably possible.
Customer Delays
Customers are responsible for ensuring the project site is ready for fabrication, delivery, or installation.
If delays occur at the customer's request or due to circumstances outside of Allen Miller Fabrication's control, installation dates and production schedules may be adjusted accordingly.
Project Hold Policy
Your deposit reserves both materials and production time.
If a customer places a project on hold:
After 30 days

The project may be removed from the production schedule.

Original installation dates cannot be guaranteed.

Work will resume based upon current scheduling availability.
After 90 days
Projects may require:

Updated material pricing

Updated labor pricing
-
Revised installation pricing

A revised estimate reflecting current market conditions
After 180 days
Projects may be considered inactive and may require:

A new estimate
-
A new production schedule
-
Updated pricing
-
An additional deposit before work resumes
Additional labor, storage, handling, or remobilization charges may also apply.
Abandoned Projects
If a project cannot proceed due to lack of customer communication, site readiness, required approvals, requested scheduling, or other customer-related delays for more than twelve (12) months after the original scheduled installation date, Allen Miller Fabrication may consider the project abandoned.
In such cases:

Deposits shall remain non-refundable.

Materials may be disposed of, repurposed, or sold at Allen Miller Fabrication's discretion.

Any future work will require a new estimate, updated pricing, and a new production schedule.

Additional deposits may be required before work resumes.
Material Pricing
Steel, stainless steel, aluminum, and other material costs fluctuate.
Customer-requested delays after materials have been purchased may require pricing adjustments reflecting current market conditions.
Change Orders
Changes requested after fabrication has begun may require:

Additional material
-
Additional fabrication time
-
Schedule adjustments

Additional charges
All changes should be approved before additional work begins.
Customer-Supplied Materials
Allen Miller Fabrication is not responsible for the quality, compatibility, performance, or longevity of customer-supplied materials, hardware, finishes, gate operators, electrical components, or other products.
No warranty, express or implied, is provided on customer-supplied items.
Job Site Access
Customers are responsible for providing safe and reasonable access to the work area.
Delays caused by inaccessible work areas, landscaping, utilities, site conditions, or other contractors may require project rescheduling.
Unsafe Job Site Conditions
Allen Miller Fabrication reserves the right to delay, suspend, or refuse work whenever job site conditions are determined to be unsafe.
Examples include, but are not limited to:

Unsafe electrical conditions

Structural instability
-
Hazardous materials
-
Aggressive animals
-
Unsafe weather conditions
-
Unsafe access to the work area
-
Any condition that could reasonably endanger employees, customers, or property
Any delays resulting from unsafe conditions may require project rescheduling.
Hidden Site Conditions
Estimates are based upon conditions reasonably visible at the time of inspection. Existing structures, concrete, foundations, underground utilities, previous workmanship, concealed damage, or other unforeseen site conditions discovered during fabrication or installation may require additional labor, materials, equipment, or modifications.
Any additional work required due to these conditions shall be treated as a change order and may result in additional charges.
Storage
Completed projects not picked up or scheduled for delivery within 30 days of completion may be subject to reasonable storage charges. Products remaining in storage for extended periods may also become subject to the Abandoned Projects policy.
Allen Miller Fabrication reserves the right to relocate stored products as necessary.
Workmanship Warranty
Allen Miller Fabrication proudly stands behind the quality of our craftsmanship.
Warranty service is available only on accounts that are paid in full unless otherwise agreed to in writing.

Right to Correct
Before the customer arranges for repairs, modifications, or replacement work by another contractor for any issue believed to be covered under warranty, Allen Miller Fabrication must first be given a reasonable opportunity to inspect and correct the issue. Unauthorized repairs or alterations may void applicable warranty coverage.

Finish Variations
Minor variations in color, gloss, texture, weld appearance, grain direction, or finish may occur due to manufacturing processes, material characteristics, powder coating batches, paint application, or natural variations in metal products.
These normal variations are not considered defects and are not covered under warranty.
Painted and powder-coated products require routine cleaning and maintenance. Damage resulting from lack of maintenance, failure to repair chips or scratches, chemical exposure, or prolonged exposure to corrosive environments is not covered under warranty.
Gate Operator Warranty
Allen Miller Fabrication warrants gate operator systems installed by our team against defects in installation and workmanship as follows:

Hardwired Gate Operator Systems — 1-Year Workmanship Warranty

Solar-Powered Gate Operator Systems — 6-Month Workmanship Warranty
Manufacturer warranties remain subject to each manufacturer's policies and conditions.
Solar Gate Operator Systems
Solar-powered gate operators are an excellent solution where utility power is unavailable or impractical. However, because these systems rely on available sunlight, charging conditions, battery performance, and environmental factors, they do not consistently provide the same level of long-term reliability as comparable hardwired systems.
For this reason, Allen Miller Fabrication provides a 6-month workmanship warranty on solar-powered gate operator installations.
Batteries are considered routine maintenance items and are specifically excluded from all warranties provided by Allen Miller Fabrication.
Battery performance and lifespan vary depending on usage, charging conditions, weather, temperature, age, and other factors beyond our control.
Whenever practical, hardwired gate operator systems are recommended for customers seeking the highest level of long-term reliability.
Warranty Claims
Warranty claims must be reported promptly after the issue is discovered.
Allen Miller Fabrication reserves the right to inspect the product before determining warranty eligibility. Repairs or replacements performed by others without prior written authorization may void warranty coverage.

Customer-supplied electrical systems

Cellular, Wi-Fi, internet, or telephone service interruptions

Third-party access control systems

Vegetation growth or shading affecting solar charging
The gate operator warranty also excludes:

Batteries
-
Battery replacement
-
Battery performance
-
Battery life
Software updates, mobile applications, network changes, internet service providers, cellular carriers, or third-party access control services are outside the control of Allen Miller Fabrication and are not covered under warranty.​
Events Beyond Our Control
Allen Miller Fabrication shall not be responsible for delays or inability to perform work resulting from events beyond our reasonable control, including but not limited to:

Natural disasters

Severe weather
-
Floods
-
Fires
-
Pandemics
-
Supplier shortages
-
Material availability
-
Transportation delays
-
Government actions
-
Utility interruptions
-
Labor shortages
-
Other unforeseen events beyond our control
Project schedules will be adjusted as reasonably necessary under these circumstances.
Natural Weathering of Steel
Steel is a natural material and may develop surface oxidation or discoloration during fabrication, transportation, or prior to finishing. Normal weathering, minor surface rust prior to coating, or discoloration associated with welding and fabrication are not considered workmanship defects.
Routine maintenance is necessary to preserve painted and powder-coated finishes.
Customer Responsibilities
Customers are responsible for:

Reviewing and approving designs before fabrication begins

Verifying dimensions when applicable

Confirming property lines

Obtaining HOA approval when required

Informing us of underground utilities

Maintaining painted and powder-coated finishes

Proper operation and maintenance of installed products
Photography
Unless otherwise requested in writing, Allen Miller Fabrication reserves the right to photograph completed projects for use in:

Our website
-
Social media
-
Advertising
-
Printed materials
-
Portfolios
Customer names, addresses, and identifying information will never be published without permission.
Custom Fabrication
Unless otherwise stated, all products fabricated by Allen Miller Fabrication are custom-built specifically for each customer.
Because of their custom nature, fabricated products are not eligible for return, exchange, or refund after fabrication has begun.
Limitation of Liability
Allen Miller Fabrication's responsibility is limited to repair or replacement of defective workmanship at our discretion.
To the fullest extent permitted by law, Allen Miller Fabrication shall not be liable for indirect, incidental, consequential, or special damages resulting from the installation, use, misuse, maintenance, or inability to use our products.
Field Fitment & Measurements
Field Measurements
Unless Allen Miller Fabrication performs the final field measurements, all customer-provided dimensions are the customer's responsibility.
Allen Miller Fabrication is not responsible for fabrication errors resulting from incorrect measurements, drawings, specifications, or information supplied by the customer or third parties.

Convertible Picnic Table Bench
Product Information
The Convertible Picnic Table Bench is a custom-built product designed to function as both a bench and a picnic table.
Because the product contains moving components, pinch points are present during operation.
Users should exercise caution while opening, closing, or adjusting the bench.
Hands, fingers, clothing, and other body parts should be kept clear of all moving components during operation.
Children should never operate or play on the product without adult supervision.
Digital Blueprint Sales
All digital blueprint sales are final and non-refundable.
By purchasing our digital plans, you acknowledge and agree that:

Construction is performed entirely at your own risk.

Allen Miller Fabrication does not supervise or inspect your build.

Material selection is your responsibility.
-
Welding quality is your responsibility.
-
Construction methods are your responsibility.
-
Safe operation is your responsibility.

Compliance with local building codes and regulations is your responsibility.
Allen Miller Fabrication assumes no responsibility for injuries, property damage, or losses resulting from construction or use of products built from our digital plans. Allen Miller Fabrication does not guarantee that products constructed from our digital blueprints will comply with local building codes, engineering requirements, permitting requirements, homeowner association requirements, or other regulations. It is the purchaser's responsibility to verify compliance with all applicable laws and regulations before construction begins.
Intellectual Property
Unless otherwise agreed to in writing, all drawings, CAD files, renderings, engineering concepts, product designs, fabrication methods, and related materials created by Allen Miller Fabrication remain the intellectual property of Allen Miller Fabrication.
The purchase of fabricated products or digital blueprints does not transfer ownership of these intellectual property rights except as specifically granted by the purchased product or license.
Bench Purchases
Allen Miller Fabrication does not ship completed Convertible Picnic Table Benches.
Completed benches are available only by:

Customer pickup at our shop, or
-
Local delivery within our normal service area.

Bench Safety Notice
This product contains moving parts and pinch points.
Hands, fingers, clothing, and other body parts should be kept clear while opening, closing, or adjusting the bench.

Routine inspection and maintenance of hinges, hardware, fasteners, and moving components is recommended.
Bench Limitation of Liability
Allen Miller Fabrication warrants the quality of its workmanship but cannot control how a product is used after delivery.
To the fullest extent permitted by law, Allen Miller Fabrication shall not be liable for injuries, property damage, or consequential damages resulting from:

Improper maintenance

Failure to operate the product safely

Failure to supervise children

Accidents occurring during use
Bench Customer Acknowledgment
By purchasing a Convertible Picnic Table Bench, the customer acknowledges that:

They understand the safety information provided.

Children should not operate the product without adult supervision.

They accept responsibility for safe operation after delivery.

They accept these Terms & Conditions.
Governing Law
These Terms & Conditions shall be governed by and interpreted under the laws of the State of Georgia.
Any dispute arising from products or services provided by Allen Miller Fabrication shall be brought in a court of competent jurisdiction located in Polk County, Georgia, unless otherwise required by law.
Acceptance
Payment of a deposit, approval of an estimate, purchase of products, purchase of digital downloads, or authorization to begin work constitutes acceptance of these Terms & Conditions unless otherwise agreed to in writing.
